Online Art Mentorship

Service: Online Creative Mentorship

 

1. Service Description

 

Online Creative Mentorship consists of individual video sessions (via video platform such as Google Meet or Zoom) focused on exploring creative patterns, overcoming blocks, and developing independent creative practice.

Sessions are conversational and exploratory in nature.

This service is NOT:

  • Art instruction or technical training

  • Therapy or mental health counseling

  • Crisis intervention or emergency support

  • Ongoing unlimited access to the mentor

 

2. Booking & Payment

 

2.1 Session Packages

  • Single Session: €110 (90 minutes)

  • Short-Term Package: €210 (3 x 60-minute sessions, valid 2 months)

  • Short-Term Package: €310 (3 x 90-minute sessions, valid 2 months)

  • Deep Dive Package: €600 (6 x 90-minute sessions, valid 3 months)

 

2.2 Payment Terms

  • Full payment is required before the first session or at the time of package purchase

  • All prices include 21% Dutch VAT (BTW)

  • Payment must be received before sessions are scheduled

  • Packages are non-transferable and non-refundable once purchased

 

2.3 Package Validity

  • Sessions must be used within the specified timeframe from the date of purchase

  • Unused sessions expire after the validity period and cannot be refunded or extended

  • Extensions may be granted only in exceptional circumstances at the mentor's sole discretion

 

3. Scheduling & Attendance

 

3.1 Booking Sessions

  • Sessions must be scheduled at least 48 hours in advance

  • Scheduling is subject to mentor availability

  • Client is responsible for attending at the scheduled time

 

3.2 Late Arrival

  • Sessions start at the scheduled time regardless of client arrival

  • If client arrives more than 15 minutes late, the session may be cancelled with no refund

 

3.3 No-Shows

  • Failure to attend a scheduled session without prior cancellation will result in forfeiture of that session

  • No refund or rescheduling will be provided for no-shows

 

4. Cancellation & Rescheduling Policy

 

4.1 Client Cancellations

  • More than 48 hours notice: Session may be rescheduled at no charge (subject to availability)

  • 24-48 hours notice: Session may be rescheduled for a €25 administrative fee

  • Less than 24 hours notice: Session is forfeited with no refund or rescheduling

 

4.2 Mentor Cancellations

  • If the mentor needs to cancel, client will be offered a reschedule at no charge

  • If rescheduling is not possible, a full refund for that session will be provided

 

4.3 Emergency Situations

  • Medical emergencies or serious unforeseen circumstances will be considered on a case-by-case basis

  • Documentation may be required

 

5. Scope of Service & Boundaries

 

5.1 What IS Included

  • Scheduled video mentorship sessions

  • Conversation and guidance during booked session time

  • Support in developing independent creative practice

 

5.2 What is NOT Included

  • Communication outside of scheduled sessions

  • Emergency or crisis support

  • Technical art instruction

  • Guaranteed creative outcomes or results

  • Review of work between sessions (unless specifically arranged)

 

5.3 Availability

  • The mentor is NOT available outside scheduled session times

  • Communication between sessions is limited to scheduling matters only

 

6. Client Responsibilities

 

The client agrees to:

  • Arrive prepared and on time for sessions

  • Engage honestly and openly during sessions

  • Take responsibility for their own creative practice between sessions

  • Respect the mentor's time and boundaries

  • Use session time productively and respectfully

 

7. Confidentiality

 

7.1 Mentor's Commitment

  • Content discussed in sessions will be kept confidential

  • No identifying information will be shared without client consent

  • The mentor may discuss general patterns, themes, and insights from mentorship work for educational purposes (such as in workshops, writing, or teaching) without revealing any client identities or personal details

 

7.2 Limitations

Confidentiality may be broken if:

  • Required by law

  • There is imminent risk of harm to self or others

  • Client gives explicit permission

 

7.3 Recording

  • Sessions may not be recorded without prior written consent from both parties

  • Any unauthorized recording is strictly prohibited

 

8. Intellectual Property

 

8.1 Client's Creative Work

  • All creative work produced by the client remains the client's intellectual property

  • The mentor makes no claim to ownership of client's creative output

 

8.2 Mentor's Materials & Methods

  • Any materials, frameworks, exercises, or resources provided by the mentor remain the mentor's intellectual property

  • These materials are for the client's personal use only

  • Client may NOT:

    • Share materials with others (online or offline)

    • Post materials on social media or websites

    • Use materials in their own teaching, workshops, or professional practice

    • Reproduce, distribute, or copy materials in any form

    • Use materials commercially or non-commercially outside of personal private use

 

9. Liability & Disclaimers

 

9.1 No Guarantees

  • The mentor does not guarantee specific creative outcomes or results

  • Success depends on client's engagement, effort, and individual circumstances

9.2 Limitation of Liability

  • The mentor is not liable for any indirect, consequential, or incidental damages

  • Total liability is limited to the amount paid for the specific service

 

9.3 Not a Substitute for Professional Services

  • This mentorship is not therapy, medical advice, or legal counsel

  • Clients should seek appropriate professional services when needed

 

10. Technical Requirements

 

10.1 Client Responsibility

  • Client must have reliable internet connection

  • Client must have access to video calling platform (Google Meet, Zoom, or other agreed platform) with working camera and microphone

  • Technical issues on client's end do not constitute grounds for refund

 

10.2 Backup Plans

  • If technical issues prevent the session, both parties will attempt to reschedule

  • Persistent technical problems may result in session forfeiture

 

11. Code of Conduct

 

11.1 Mutual Respect

  • Both parties agree to interact respectfully and professionally

  • Harassment, discrimination, or abusive behavior will not be tolerated

 

11.2 Termination

The mentor reserves the right to terminate the mentorship relationship if:

  • Client violates these terms

  • Client behaves disrespectfully or abusively

  • The mentor determines the relationship is no longer productive

 

Refund Policy Upon Termination:

  • If termination is due to client's violation of terms or inappropriate behavior: No refund for unused sessions

  • If termination is due to other reasons at mentor's discretion: Prorated refund for unused sessions will be provided

 

12. Data Protection & Privacy (GDPR)

 

12.1 Data Collection

The mentor collects and processes the following personal data:

  • Name and contact information (email, phone)

  • Payment information (processed securely through payment provider)

  • Session notes and creative development information

 

12.2 Purpose of Data Processing

Personal data is collected and used solely for:

  • Providing mentorship services

  • Scheduling and communication

  • Payment processing

  • Maintaining session continuity

 

12.3 Data Storage & Security

  • All personal data is stored securely

  • Data is kept only as long as necessary for service provision and legal requirements

  • Client data will be retained for 7 years for tax purposes (Dutch legal requirement)

  • Session notes may be kept longer for continuity of service

 

12.4 Your Rights

Under GDPR, you have the right to:

  • Access your personal data

  • Request correction of inaccurate data

  • Request deletion of your data (after legal retention period)

  • Object to data processing

  • Request data portability

12.5 Data Sharing

Personal data will not be shared with third parties except:

  • Payment processors (for transaction processing)

  • When required by law

 

13. Mentor Unavailability

 

13.1 Short-Term Unavailability

If the mentor becomes temporarily unavailable (illness, emergency), sessions will be rescheduled at no additional cost within the package validity period.

 

13.2 Extended Unavailability

If the mentor is unable to fulfill services for an extended period (more than 2 weeks):

  • Clients will be notified immediately

  • Package validity periods will be extended accordingly

  • If services cannot be resumed within a reasonable timeframe, prorated refunds will be issued for unused sessions

 

14. Changes to Terms

The mentor reserves the right to modify these terms at any time. Changes will apply to services booked after the modification date. Existing packages will be honored under the terms at the time of purchase.

 

15. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes will be resolved under Dutch jurisdiction.

Language: These Terms & Conditions are available in both English and Dutch. In case of any conflict or discrepancy between the English and Dutch versions, the Dutch version shall prevail.

 

16. Agreement

By booking and paying for Online Creative Mentorship services, the client acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions.
